Welcome to Buffalo Film Studios. Below you will find our combined Terms of Service and Privacy Policy. We believe in transparency and keeping things simple.

Part A: Privacy Policy

At Buffalo Film Studios, we value your privacy. This section explains how we handle your personal information.

1. Information Collection

We collect information necessary to provide our services, such as your name, contact details, and project specifics. This happens when you fill out a form, book a service, or communicate with us.

2. How We Use Your Data

  • To manage your account and project.
  • To communicate updates and provide our services.
  • With your consent, to send occasional promotional updates (which you can opt-out of anytime).

3. Data Storage & Security

We use industry-standard practices and secure third-party tools (like CRM and cloud storage) to keep your data safe. We do not sell your personal information to third parties.

4. Cookies & Analytics

Our website may use cookies to improve your browsing experience and analyze site traffic.

5. Your Rights

Part B: Terms of Service

These terms apply to all interactions and projects with Buffalo Film Studios.

1. Booking and Financial Commitment

1.1. Deposit: A 50% deposit is required to confirm all production bookings. No filming, editing, or pre-production work will commence until this deposit has been cleared.
1.2. Non-Refundability: Deposits are non-refundable once pre-production has commenced. Pre-production is defined as any project planning, scripting, correspondence, or resource allocation performed following client confirmation.
1.3. Early Cancellation: If a client cancels before pre-production begins, Buffalo Film Studios may, at its sole discretion, refund up to 50% of the deposit.

2. Payment Terms

2.1. Final Balance: The remaining 50% balance is due upon completion of the project and prior to the delivery of final, high-resolution files.
2.2. Completion Defined: Completion occurs when Buffalo Film Studios has fulfilled the agreed filming and editing scope and a preview draft has been supplied for review.
2.3. Payment Window: Final payment is required within seven (7) days of the preview delivery unless otherwise agreed in writing.
2.4. Progress Invoicing: For projects exceeding four (4) weeks or involving multiple phases, Buffalo Film Studios reserves the right to issue progress invoices. These must be settled within seven (7) days to maintain production continuity.
2.5. Late Payments: Buffalo Film Studios reserves the right to charge interest on any overdue invoices at a rate of 2% per month, calculated daily, until the balance is paid in full.

3. The Creative Process: Revisions

3.1. Revision Scope: Our standard quotes include up to three (3) rounds of revisions, provided feedback is supplied within seven (7) days of receiving each draft.
3.2. Extended Feedback: Revisions requested outside the seven-day window may be treated as a new phase of work and incur additional fees.
3.3. Minor vs. Major: Minor revisions (text changes, logo swaps, brief edits) are covered within the rounds. Major structural or stylistic changes requested after the initial brief will be quoted separately.

4. Cancellation and Rescheduling

4.1. Short-Notice Cancellation: Cancellations made less than seven (7) days before a scheduled shoot will result in the forfeiture of the full deposit.
4.2. Work Performed: If a project is cancelled after work has commenced, Buffalo Film Studios reserves the right to invoice for all hours spent on pre-production, filming, and post-production.
4.3. Rescheduling: Rescheduling is permitted at no cost if notice is given at least seven (7) days prior to the shoot, subject to studio and crew availability.

5. Intellectual Property and Ownership

5.1. Raw Footage: Buffalo Film Studios retains ownership of all raw footage and project files unless otherwise agreed in writing.
5.2. Usage Rights: Upon receipt of full payment, the client is granted full usage rights to the final edited video(s).
5.3. Promotional Rights: Buffalo Film Studios reserves the right to use excerpts of completed work for promotional and portfolio purposes, showcasing our shared vision, unless a non-disclosure request is made in writing.

6. Client Responsibilities

6.1. Permissions: The client is responsible for ensuring filming locations, permits, and participants are ready as scheduled.
6.2. Clearances: The client warrants that all materials or logos supplied to Buffalo Film Studios do not infringe on third-party rights and indemnifies the studio against any claims.

7. Liability and Force Majeure

7.1. Reasonable Care: While we take every precaution, Buffalo Film Studios is not liable for circumstances beyond our control, including equipment failure, extreme weather, pandemics, or government restrictions (Force Majeure).
7.2. Liability Cap: In no event shall Buffalo Film Studios’ total liability exceed the total amount paid by the client for the specific project.

8. Dispute Resolution

8.1. Good Faith: Both parties agree to resolve any disagreements through good-faith negotiations.
8.2. Mediation: If a resolution is not reached within thirty (30) days, both parties agree to attempt professional mediation before initiating formal legal proceedings.
